Ultraskier Copyright Information and Terms and Conditions of Use

The straight dope version

Readers of Ultraskier take the advice given out here at their own risk. Skiing and life in general are dangerous business and those who dislike pain and injury would be well-advised to stick to staying home and watching TV. Any other activity is likely to lead to injury at some point, and none of the responsibility for that injury falls to Ultraskier. You need to know your limits, use your common sense and have your health and life insurance paid up.

Authors of articles on Ultraskier.com retain copyright of their own articles, images and other materials that they created. However, authors provide Ultraskier.com an indefinite usage license and that license is exclusive for three years online for articles in their present form (in other words, you can publish a substantially new and revised version elsewhere, but not the same version). Similarly, authors agree not to republish on Ultrasker.com articles that they have already published elsewhere and not publish anything written by someone else that they have reworded or rewritten (this is a common practice, but it is illegal because that constitutes a derivative work which is covered under copyright law and it is plagiarism, which is despicable and immoral and makes your teeth fall out). This makes things nice and legal, easier for everyone and also avoids duplicate content penalties from the search engines (i.e. Google). Trust me, it's better for both of us if you rewrite and update your article rather than to farm it out in the same form to multiple places.

Ultraskier uses some stock photos, to which we have a license, but do not hold copyright. Other materials are copyright Ultraskier.com. Those wishing to republish materials found on Ultraskier.com, including but not limited to articles, images, videos, logos and other materials, must obtain prior written consent. In the case of Ultraskier articles written by individual contributors, that person still holds copyright and must consent as well.

If you are an author, do not upload any picture, text or video unless you are the creator and you hold copyright or have licensed it from the copyright holder. If you aren't sure, don't upload it. Just because a photo is on Flickr.com under a Creative Commons License does not mean you can use it. A large number of those photos, in my experience, are posted by people who do not own copyright and therefore have no right to grant use under the Creative Commons License.

If you see a copyright violation, please notify us immediately via our contact form. We will do our best to protect your copyright.

Ultraskier does not consent to allow children under 13 to register. If we did, we would have to track various things to stay in legal compliance with child protection laws and we're both too lazy to track that and we don't know how. Sorry. If you're 12, you can't register. And should be playing outside anyway.

For those 13 and over, you should be playing outside too, but we'll let you register anyway. Users must agree to abide by the terms of the site that means, most importantly:

  1. Respect to other users. Insulting and offensive comments will be edited and repeated offenders will be banned. This includes personal attacks and comments that might be seens attacks based on race, religion, gender and whether one is a skier or snowboarder, or an tele skier or alpine skier (I think that stuff is behind us finally isn't it?). Be nice or go somewhere else. If you would be embarassed to have your mother see what you wrote, please just delete it and start over.
  2. Ultaskier can't police everything and standards of decency are relative. So there may be something here you find offensive or users may post links to offensive sites. We can't stop everything, but if you have a complaint, contact us immediately and we will try to deal with it.
  3. No irrelevant commercial promotion. In this case, that mostly means you may promote ski-related services. Indeed, the whole point of this site is to allow you to do so. But don't even think about posting about the latest registry cleaner or colon cleanse product. Is your business ski-related?. Here's a test: are you primarily focussed on improving the on-snow experience for your clients or the off-snow experience or general health? Sorry, if your business is a hotel, restaurant, resort realty or some killer herbal supplement that will make me ski like Bode Miller, please don't make me ban you. Not to pick on realtors and herbal supplement folks, but you know that you're some of the most aggressive marketers out there and there's good money in your business. Go buy ads somewhere. Or actually, contact me about buying ads on Ultraksier. I could use the money.
